Nearly 100 Dispensaries Across Ohio to Begin Selling Recreational Marijuana on Tuesday

The Ohio Department of Commerce Division of Cannabis Control (DCC) announced Monday that 98 eligible cannabis dispensaries across the Buckeye State will be issued dual-use Certificates of Operation to begin selling recreational and medical marijuana to consumers on Tuesday.

Last November, Ohio voters passed an initiative – Issue 2 – to legalize recreational marijuana in the state. Issue 2 passed with 56.97 percent of the vote.

The law officially took effect in December, allowing adults 21 years and older to use, possess, and transport marijuana that is legally obtained in the State. An adult consumer is also permitted to transfer marijuana to another adult consumer, as long as the transfer is without compensation and is not advertised or promoted to the public.

With regard to growing marijuana, adults 21 years and older are permitted to grow and possess no more than six cannabis plants at the individual’s primary residence. There is a limitation of no more than 12 cannabis plants per residence where two or more people 21 years and older reside at one time.

The law also sets a sales tax rate of 10 percent on marijuana purchases, in addition to any existing sales taxes.

While the law officially took effect in December, the Ohio DCC was given a deadline of September 7, 2024 to issue its first set of Certificates of Operation to dispensaries.

Ahead of schedule by more than a month, the Ohio DCC will officially issue Certificates of Operation on Tuesday to dispensaries that meet requirements in terms of inventory availability, employee badging and training, security requirements, and other conditions.

“A big reason we were able to get to this point ahead of the Sept. 7 deadline was due to the foundation laid through the state’s existing Medical Marijuana Control Program,” Ohio DCC Superintendent James Canepa said in a statement. “Since existing licensees had already met stringent requirements of that program, we anticipated this process to be rather smooth. They had already undergone many of the comprehensive checks as part of that process.”

As the Ohio DCC issues Certificates of Operation to dispensaries, an online map on the Division’s website will be updated with all licensed dispensaries serving consumers across the Buckeye State.
